Is Cash for Keys A Safer Option Than Eviction?
A cash for keys agreement is a voluntary arrangement in which you offer a tenant money or another agreed benefit in exchange for moving out by a specific date and returning possession of the rental property.
The arrangement may help when a tenancy is no longer working but a formal eviction could require additional time, legal expense, missed rent, and uncertainty. It can also give the tenant relocation funds and a defined move-out schedule.
Cash for keys is not a shortcut for forcing someone out. The tenant must be free to reject the offer, and the agreement must comply with the rules where the property is located. Some cities and counties regulate tenant buyouts through mandatory disclosures, minimum payments, filing requirements, translations, or cancellation periods.

Compare the Agreement With the Cost of Continuing
Before making an offer, estimate what the unresolved tenancy may cost, and ensure that you factor that impact into to your rental cycle.
Assume a tenant owes $3,000, the property rents for $1,500 per month, and you expect the legal process and turnover to require another two months.
Your potential exposure might include:
| Cost category | Estimated amount |
|---|---|
| Additional lost rent | $3,000 |
| Filing and legal costs | $1,200 |
| Turnover repairs and cleaning | $1,000 |
| Utilities and lawn care | $250 |
| Leasing and advertising | $750 |
| Estimated total | $6,200 |
An agreement offering $2,000 for timely surrender could be financially rational if it shortens the vacancy and gives you reliable possession. The offer is not necessarily a reward for nonpayment. It may be the lower-cost business option.
Do not compare the payment only with the rent owed. Compare it with the total time, expense, property risk, and uncertainty associated with the alternatives.
Know What You Are Actually Negotiating
Money is only one part of a cash for keys arrangement. A usable agreement should resolve possession, timing, property condition, access, pending claims, and payment.
You and the tenant should understand:
- The exact date and time possession will be returned
- The amount and form of payment
- When the payment becomes due
- Who must leave the property
- Whether all keys, remotes, and access devices must be returned
- What happens to personal property left behind
- How the security deposit will be handled
- Whether unpaid rent is waived, reduced, preserved, or addressed separately
- What happens to a pending eviction case
- What occurs if either party does not perform
A vague promise such as “I’ll give you $1,500 if you move soon” is not enough. “Soon” is not a deadline, and “move” does not establish whether the unit must be vacant, undamaged, and free of personal property.
Keep the Offer Voluntary
Present the proposal as an option, not a threat.
You may explain that the tenant can accept the agreement, reject it, or seek legal advice. Avoid repeated pressure, utility shutoffs, lock changes, removal of doors, interference with services, or statements suggesting that the tenant has no choice.
If the tenant rejects the proposal, you must follow the lawful process available in your jurisdiction. A cash for keys offer does not give you the right to bypass eviction notices, court procedures, lease protections, or just-cause rules.
Local requirements can be much stricter than a general agreement suggests. Los Angeles County’s tenant buyout requirements, for example, include written disclosures, specific agreement language, translation obligations, filing steps, minimum offer rules for covered tenants, and a period during which the tenant may cancel.
That does not mean the same requirements apply everywhere. It shows why you should review local law before discussing an amount or presenting a form.
Set Payment for the Possession Handoff
The agreement should make payment timing unmistakable.
A common structure is for the landlord to deliver the agreed funds after the tenant has:
- Vacated the property by the deadline
- Removed occupants and personal belongings
- Returned all keys and access devices
- Delivered possession to the landlord
- Completed any agreed walkthrough or handoff
You might meet at the property, confirm that possession has been surrendered, sign a receipt, and exchange the payment for the keys.
Do not leave the timing open to interpretation. If part of the payment is due at signing and the balance at move-out, state both amounts and dates. If local rules create a cancellation period, confirm whether and when payment may lawfully be delivered.
The agreement should also explain what happens if the tenant misses the deadline. Avoid assuming that you can immediately change the locks. You may still need to continue or begin the formal legal process.
Treat the Security Deposit Separately
The cash for keys payment and security deposit serve different purposes.
The buyout payment is consideration for the tenant’s voluntary surrender under the agreement. The security deposit remains subject to state and local rules governing permitted deductions, itemization, documentation, and return deadlines.
Do not write that the tenant automatically forfeits the entire deposit unless local counsel confirms that provision is lawful. Instead, state that the deposit will be processed separately under the lease and applicable law.
You should inspect and photograph the property at possession. Separate ordinary wear, tenant damage, unpaid rent, abandoned property, and the agreed buyout amount in your records.
When a Court Case Is Already Pending
If you have already filed an eviction case, an informal side agreement may not be enough.
Court-connected mediation can allow both sides to agree on a move-out date, payment terms, back rent, repairs, and the treatment of the pending case. California Courts’ guidance on eviction mediation recommends putting the terms into a formal written agreement and identifying when the landlord will dismiss the case if the tenant performs.
Your agreement should state whether the case will be paused, dismissed immediately, or dismissed only after the tenant has surrendered possession and completed the agreement. Local court procedures control how that is done.
Have an attorney review any settlement involving a pending case. An unclear filing or premature dismissal could leave you without possession and require you to restart the process.

Run a Final Compliance Check
Before presenting the agreement, confirm:
- Whether the tenancy is rent-controlled or subject to just-cause protection
- Whether relocation assistance is already required
- Whether your jurisdiction regulates buyout offers
- Whether disclosures or translations are mandatory
- Whether the tenant has a cancellation right
- Whether the agreement must be filed or reported
- Whether all lawful occupants must sign
- Whether an attorney should review the agreement
- How a pending court case will be handled
- How the security deposit and unpaid balance will be processed
New York City’s Buyout Agreement Law, for example, requires owners to report specified information after entering covered agreements. Rules like these can make a generic template incomplete or unenforceable.
Final Thoughts
A cash for keys agreement can give you a defined move-out date, reduce legal expense, shorten vacancy, and help the tenant cover relocation costs. Its value comes from certainty—not from avoiding the law.
Compare the payment with the full cost of continuing the dispute. Keep the offer voluntary. Put every material term in writing. Tie payment to a clear possession handoff, handle the security deposit separately, and coordinate any pending court case carefully.
Most importantly, verify local requirements before making the offer. A well-drafted agreement can resolve a difficult tenancy. A vague or noncompliant agreement can create a second dispute before the first one is finished.
